1. Acceptance of Terms

By accessing or using SEO Test Online (seotest.online), you agree to be bound by these Terms & Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Topranker.cz ("we", "us", or "our"), the operator of this service.

If you do not agree with any part of these Terms, you must not use our service. Your continued use of SEO Test Online constitutes your ongoing acceptance of these Terms.

These Terms apply to all visitors, users, and anyone who accesses or uses the service in any way, including browsing the website, submitting URLs for analysis, or receiving reports via email.

2. Service Description

SEO Test Online is a free online SEO analysis tool that provides automated website audits and recommendations. The service includes, but is not limited to, the following features:

• Automated website analysis — on-page SEO factors, meta tags, headings, content quality, internal and external links, image optimization, schema markup, and other technical SEO elements.
• Performance evaluation — page loading speed, Core Web Vitals, and PageSpeed metrics via the Google PageSpeed Insights API.
• Report generation — comprehensive SEO reports with overall scores, categorized issues, and actionable recommendations for improvement.
• Report delivery via email — analysis results are sent to the email address you provide during submission.
• Optional subscription to SEO tips — with your explicit consent, you may subscribe to receive periodic SEO tips, guides, and recommendations via email.

The service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, update, suspend, or discontinue any aspect of the service at any time, with or without notice, and without liability to you.

We may introduce new features, change existing functionality, impose usage limits, or alter the scope of the analysis at our sole discretion. Free access to the service is not guaranteed indefinitely and may be subject to change in the future.

3. User Registration & Accounts

SEO Test Online does not require user registration or the creation of user accounts. The service operates on a per-request basis.

To use the SEO analysis feature, you need to provide:

• A valid URL of the website you wish to analyze.
• A valid email address where the analysis report will be delivered.

You are responsible for ensuring that the information you provide is accurate and up to date. We are not responsible for undelivered reports resulting from incorrect or invalid email addresses.

By providing your email address, you acknowledge that it will be used in accordance with our Privacy Policy and the email communications provisions described in Section 6 of these Terms.

4. Acceptable Use

You agree to use SEO Test Online only for lawful purposes and in compliance with these Terms. When using our service, you agree to the following:

4.1 Permitted Use

• You may analyze websites that you own or operate.
• You may analyze websites for which you have explicit authorization from the owner (e.g., client websites if you are an SEO professional or web developer).
• You may use the generated reports for your own business purposes, including sharing them with clients or stakeholders.

4.2 Prohibited Use

You agree not to:

• Analyze websites that you do not own and do not have explicit permission to analyze.
• Provide false, misleading, or inaccurate information (including fake email addresses or URLs).
• Use automated scripts, bots, scrapers, or any other automated means to access or interact with the service, unless explicitly authorized through an API we may provide.
• Attempt to overload, disrupt, damage, or interfere with the proper functioning of the service or its underlying infrastructure.
• Attempt to gain unauthorized access to any part of the service, its servers, databases, or connected networks.
• Circumvent, disable, or otherwise interfere with rate limits, security measures, or access restrictions implemented on the service.
• Use the service for any illegal, harmful, or fraudulent activity.
• Use the service to collect information about third parties without their consent.
• Reverse-engineer, decompile, or attempt to extract the source code of the service or its analysis algorithms.

4.3 Rate Limiting

To ensure fair usage and maintain service quality for all users, we implement rate limiting. The number of analyses permitted per IP address and per email address is limited within a given time period. Specific limits may be adjusted at our discretion without prior notice. Exceeding these limits may result in temporary or permanent restriction of access.

5. Intellectual Property

5.1 Our Intellectual Property

All content, design, graphics, user interfaces, code, software, algorithms, analysis methodologies, scoring systems, and other materials available through SEO Test Online are the exclusive property of Topranker.cz or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws of the Czech Republic and international treaties.

The SEO Test Online name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Topranker.cz. You may not use such marks without our prior written permission.

5.2 Your Rights to Generated Reports

You are granted a limited, non-exclusive, non-transferable license to use the SEO analysis reports generated for URLs you submit for your own personal or business purposes. This includes:

• Viewing and downloading your reports.
• Sharing reports with your clients, colleagues, or stakeholders.
• Using report data to inform SEO decisions for websites you manage.

5.3 Restrictions

You may not:

• Redistribute, resell, sublicense, or white-label the service or any part of it.
• Copy, replicate, or reverse-engineer the analysis methodology, scoring algorithms, or any proprietary technology used by the service.
• Present the service as your own or create derivative works based on it without our explicit written consent.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the service or reports.

6. Email Communications & Marketing

6.1 Transactional Emails

By submitting a URL for analysis, you agree to receive a transactional email containing your SEO analysis report. This email is a necessary part of the service delivery and cannot be opted out of — if you do not wish to receive the report via email, please do not use the service.

6.2 SEO Tips Subscription (Marketing Emails)

During the submission process, you may optionally consent to receiving SEO tips, guides, and recommendations via email. This subscription operates on a double opt-in basis:

1. You check the subscription checkbox on the analysis form (first opt-in).
2. You receive a confirmation email and must click the confirmation link to activate the subscription (second opt-in).

Marketing emails will only be sent after both opt-in steps are completed. This process complies with GDPR and applicable anti-spam regulations.

6.3 Unsubscribing

You can unsubscribe from marketing emails at any time by:

• Clicking the "Unsubscribe" link included in every marketing email.
• Contacting us directly at the email address provided in Section 15.

Please note that unsubscribing from marketing emails does not affect transactional emails related to service delivery (i.e., your analysis reports).

7. Data Accuracy & Disclaimer

SEO Test Online provides automated analysis based on publicly available information from the websites you submit. It is important to understand the following:

• Analysis results are generated by automated algorithms and are provided as recommendations only, not as definitive SEO verdicts or professional advice.
• We make no guarantees regarding the accuracy, completeness, timeliness, or reliability of the analysis results.
• SEO best practices evolve over time as search engines update their algorithms. Results and recommendations may become outdated or may not reflect the most current SEO standards.
• The analysis is based on a single point-in-time snapshot of the submitted URL. Results may vary depending on server response times, geographic location, caching, and other technical factors.
• Scores and ratings are relative indicators and should be interpreted as general guidance, not absolute measures of SEO quality.

8. Service Availability

We strive to maintain reasonable availability of SEO Test Online, but we do not guarantee uninterrupted, error-free, or continuous access to the service.

The service may be temporarily unavailable due to:

• Scheduled maintenance — periodic updates, improvements, and server maintenance.
• Unscheduled downtime — server failures, hardware issues, software bugs, or other technical problems.
• Third-party service outages — disruptions to APIs we depend on (e.g., Google PageSpeed Insights API, Cloudflare services, email delivery providers).
• Force majeure — events beyond our reasonable control, including but not limited to natural disasters, power outages, network failures, cyberattacks, government actions, or pandemics.

We reserve the right to modify, suspend, or permanently discontinue the service (or any part of it) at any time, with or without notice, and without obligation to any user.

No compensation will be provided for any downtime, service interruption, or discontinuation of the service, whether planned or unplanned.

9. Third-Party Services & Content

SEO Test Online relies on and may reference various third-party services to provide its functionality:

9.1 Third-Party APIs and Services

• Google PageSpeed Insights API — used to evaluate page performance and Core Web Vitals. The availability and accuracy of PageSpeed data are governed by Google's terms of service.
• Cloudflare — used for CDN, security, and CAPTCHA verification (Turnstile). Cloudflare's services are subject to their own terms and privacy policy.
• SendPulse — used for email delivery and CRM. Email processing is subject to SendPulse's terms of service.

We are not responsible for the availability, accuracy, reliability, or performance of any third-party services. Changes or disruptions to third-party services may affect the functionality or results of our analysis.

9.2 External Links

Our reports and website may contain links to external websites and resources provided for your convenience and reference. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Visiting external links is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

10.3 Maximum Liability

Our total aggregate liability for any and all claims arising out of or relating to the use of the service shall not exceed the total amount you have paid to us for the service. As SEO Test Online is a free service, this amount is zero (0).

11. Indemnification

You agree to defend, indemnify, and hold harmless Topranker.cz, its owners, officers, employees, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of or access to the service.
• Your violation of these Terms.
• Your violation of any applicable law, regulation, or third-party rights.
• The unauthorized analysis of third-party websites without the owner's permission.
• Any content or data you submit through the service.
• Any dispute between you and a third party arising from your use of the service.

This indemnification obligation shall survive the termination of these Terms and your use of the service.

12. Termination

12.1 Termination by Us

We reserve the right, at our sole discretion, to restrict, suspend, or terminate your access to the service at any time, without prior notice, for any reason, including but not limited to:

• Violation of these Terms or our Privacy Policy.
• Abusive, excessive, or fraudulent use of the service.
• Automated or bot-driven access to the service.
• Attempts to circumvent rate limits or security measures.
• Any conduct that we determine, in our sole discretion, to be harmful to the service or other users.

12.2 Methods of Restriction

Restrictions may be implemented through:

• Blocking of specific IP addresses or IP ranges.
• Blocking of specific email addresses or email domains.
• Automatic rate limiting (temporary or permanent).

12.3 Effect of Termination

Upon termination of your access, previously generated reports will remain accessible at their existing URLs until their natural expiration period (30 days from creation). We are under no obligation to maintain, store, or provide access to any data or reports beyond this period.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, disclaimers, limitation of liability, and indemnification.

13. Modifications to Terms

We reserve the right to modify, amend, or replace these Terms at any time and at our sole discretion.

When changes are made:

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the use of the service shall be subject to the exclusive jurisdiction of the competent courts of the Czech Republic.

14.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

14.4 No Waiver

The failure of Topranker.cz to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Topranker.cz.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Topranker.cz regarding the use of SEO Test Online, and supersede any prior agreements, communications, or understandings, whether written or oral.
